Unit trusts are a type of trust that usually entitles the unitholders to a fixed interest to income or capital. Unit holders may have a proprietary interest in the assets or income of the trust. The beneficiaries of the trust may be entitled to the trust’s income proportional to the number of units that individual or entity holds. Some reasons to establish a unit trust may include:

  • Fixed Interest – Unit holders have a fixed interest in income or capital. Generally, the Trustee of a fixed unit trust must distribute all income for the financial year to the unitholders.
  • Tax Benefits - A unit trust is generally not taxed, but rather the unit holders are taxed on their share of the income. Unit trusts may also benefit from a capital gains tax concession – if applicable, the trust may be entitled to a 50% discount on the disposal of assets. In addition, there are also some tax deductions available for businesses that are run using a trust.
  • Succession Planning – A unit trust can operate for as long as is specified in the trust deed, up to 80 years. This enables long-term planning for the welfare of the beneficiaries. In addition, raising capital to expand your business is relatively easy as new units can be issued or sold.

We offer an optional printing service that will provide you with a tabbed leather feel burgundy folder that has all your documents printed and your trust deeds professionally bound.
How long does it take to establish a unit trust?
The order form for a unit trust usually takes about 5 minutes to complete. Once your order completes, the PDF copy of the documents will be available in minutes. We will send you an email confirmation that everything is ready. If you require the full trust register, this will be carefully prepared and sent out within 1 business day and delivered using our secure couriers.

Do you stamp trust deeds?
Yes, we provide a stamping service for Victorian Register Trust deeds ONLY. If you require this service, you can select it from the Add-On sidebar at the end of your order. This is a complimentary service, which means you only pay the statutory $200 stamp duty and no more. No attendance fees! This will provide a certificate of duty showing your trust has been stamped by the State Revenue Office.
What if my trust is not going to be registered in Victoria?
If your trust is going to be registered in any state other than Victoria, then regretfully we cannot undertake organising the stamping of those deeds. This is because every single State in Australia has slightly different requirements for stamping, and usually a different cost. Some states don’t charge any stamp duty on trusts. If you order a trust that won’t be registered in Victoria, then we suggest contacting the relevant State Revenue Office (or equivalent) to find out what is required for your deeds.
